From the Editor’s Desk
Himachal Pradesh National Law University, Shimla (HPNLU, Shimla) has traversed its journey of a decade. In this period, the University has initiated intensive academic research in various fields. There are multiple factors that augment this research-led academic environment at the University. The ‘Shimla Law Review’ (SLR), UGC CARE Indexed, as flagship publication, publishes articles by professors, judges, practitioners and scholars on legal and philosophical issues having contemporary relevance and are intended to contribute to the discourse and policy initiatives. The SLR has tried, since its inception, to promote inter & multi-disciplinary research. The Review encourages submissions related to multiple themes and diverse fields. The papers published, in its previous volumes, have received accolade from academicians, bar & bench alike. It is one of the law journals published in India which have made its presence internationally.
The present Volume-VII (April 2024-March 2025), comprehensively, covers, the ongoing debate and legislative proposal of ‘One National One Election (ONOE)’ from multiple perspectives and highlights the essentials that can guide policy-making with respect to the same. Four articles on ONOE, included in the Volume, dwell deeper into the philosophical foundations and ideas of elections, democracy, nation, Constitutional provisions and representation. Another manuscript covers the role of the Election Commission of India in conducting elections, its historical successes and the role it can play in the current context of one nation one election. It may be pointed out to the readers that SLR is first to take up the debate in its multifarious dimensions by publishing four long research papers on the subject which, I am confident, shall contribute significantly, to law and policy making and facilitate the maturity and fortification of Constitutional project of democracy in India.
In the Age of technology, one cannot research enough about the trends that artificial entities are going to set. The USA and the EU countries have moved much ahead in use and in regulating AI for criminal justice administration compared to India. However, the use of AI poses greater challenge for liberties of Individuals and for its regulation and control by law.
Interestingly, as a continuation of the Article, from the previous Volume, relating to the USA, by Professor Paul & Dr. Georgios, the present volume contains, the second manuscript, on the use of artificial intelligence in court management and justice delivery system, with reference to developments in various jurisdictions of the EU.
Withal, it also presents a manuscript on the idea of how artificial entities can shape the future of the legal systems and incorporating the rights of these entities for better regulation.
Further, the volume has some categorical insights on the posthumanism and future of legal and social theory. An article on deeper issues with respect to drafting of legislations, exemplifying ‘the Sexual Harassment of Women (Prevention, Prohibition and Redressal) Act, 2013’, from feminist perspective is included, which brings new dimensions on the subjects. The Volume also covers the recent legislative development and decriminalisation under the Companies Act, 2013, including, latest jurisprudential trends set by the Hon’ble Supreme Court. There are notes/ comments on alternative narrative of Uniform Civil Code, in its experience of Civil Law traditions and its future in India, and on the important judgements of the Supreme Court.
I am delighted to present, Volume VII of the Shimla Law Review, to you with the hope, that the research articles, in the volume, shall enrich the discussions on subjects and open ways for further research and deliberations. I congratulate the contributors and the editors for their endeavours, academic sincerity, and commitments.
